1. Overview

This website is operated by Kyle Bell LLC under the Bluvana name. Throughout these Terms, “Bluvana,” “we,” “us,” and “our” refer to Kyle Bell LLC. Bluvana provides this website and its related information, products, features, tools, and services (collectively, the “Services”) to you conditioned on your acceptance of these Terms of Service.

By visiting, interacting with, or purchasing through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

2. Eligibility and accounts

You must be at least the age of majority in your place of residence to use the Services or have the involvement and consent of a parent or legal guardian. Information you provide must be accurate and current. You are responsible for safeguarding any account credentials and for activity under your account.

3. Products and product information

We make reasonable efforts to describe and display products accurately. Colors and appearance may vary by screen and device settings. Measurements may vary within the tolerances stated on the product page. Product descriptions, pricing, availability, and assortments may change without notice.

We may limit quantities, discontinue products, or decline an order when reasonably necessary, including for suspected fraud, pricing errors, inventory issues, or misuse of the Services.

4. Orders, changes, and cancellations

Submitting an order is an offer to purchase. An order is accepted when we send confirmation of acceptance or fulfill the order. We may reject or cancel an order and will refund any amount collected for an order we do not accept.

Review your order and address before submitting it. You may request a change or cancellation through info@trybluvana.com before fulfillment. We will try to help, but changes and cancellations are not guaranteed after processing begins.

5. Prices, payment, and taxes

Prices are shown in U.S. dollars unless stated otherwise. You agree to provide current and accurate payment and billing information. Applicable taxes and shipping charges are displayed during checkout before payment. We may correct genuine pricing or listing errors; if an error affects an order, we may contact you for instructions or cancel and refund the order.

6. Shipping and delivery

We currently ship only within the United States. Most orders are processed in 1–2 business days, followed by an estimated 2–7 business days in transit, unless a product description states otherwise. Delivery dates are estimates and may be affected by carriers, weather, holidays, address issues, or other events outside our reasonable control. Additional details are in our Shipping Policy.

7. Returns and refunds

Eligible items may be returned when requested within 30 calendar days after confirmed delivery. Return conditions, free return-shipping procedures, Final Sale exclusions, and refund timing are described in our Return and Refund Policy, which is incorporated into these Terms.

8. No voluntary product warranty

Bluvana does not offer a voluntary product warranty. This does not exclude or limit any warranty, consumer right, or remedy that cannot lawfully be excluded.

9. Intellectual property

The Services and their original content, design, text, graphics, logos, photographs, video, audio, and other materials are owned by Kyle Bell LLC or its licensors and are protected by applicable intellectual-property laws. You may use the Services only for personal, noncommercial purposes. You may not copy, reproduce, distribute, modify, republish, scrape, or commercially exploit protected material without prior written permission, except as permitted by law.

10. Reviews, feedback, and submissions

If you submit a review, image, suggestion, or other feedback, you confirm that you have the right to provide it and that it is accurate and lawful. You grant Bluvana a nonexclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, and display the submission in connection with operating and promoting the Services. We may moderate or remove submissions that violate these Terms or applicable law.

11. Third-party services and links

The Services may include tools, payment services, applications, or links operated by third parties, including Shopify. Third-party services are governed by their own terms and privacy notices. Bluvana is not responsible for third-party sites or services that we do not control.

12. Relationship with Shopify

Bluvana is powered by Shopify, which enables us to provide the Services. Purchases from this store are transactions directly between you and Kyle Bell LLC, not Shopify. To the extent permitted by law, Shopify is not responsible for products sold by Bluvana or for claims arising from those transactions.

13. Prohibited uses

You may not use the Services to violate law; infringe intellectual-property, privacy, or other rights; transmit malware; engage in fraud or deception; harass or harm others; interfere with security or operation; collect personal information without authorization; send spam; impersonate another person; or attempt to bypass access or security controls.

14. Disclaimer of services

To the fullest extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee that the Services will always be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

15. Limitation of liability

To the fullest extent permitted by law, Kyle Bell LLC and its directors, officers, employees, contractors, service providers, affiliates, agents, and licensors will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages, or for lost profits, revenue, savings, or data arising from use of the Services or products purchased through them. Nothing in these Terms excludes liability that cannot lawfully be excluded.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold Kyle Bell LLC and its affiliates, personnel, contractors, service providers, and licensors harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your violation of another person’s rights.

17. Severability and waiver

If a provision of these Terms is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver.

18. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms as part of a merger, reorganization, sale of assets, or other lawful business transaction.

19. Governing law

These Terms are governed by the laws of the State of Utah and applicable federal law, without regard to conflict-of-law rules. Any dispute that may lawfully be subject to an exclusive forum will be brought in the state or federal courts serving Salt Lake County, Utah. Mandatory consumer protections in your place of residence remain unaffected.

20. Changes to these Terms

We may update these Terms to reflect operational, legal, or regulatory changes. The current version and “Last updated” date will appear on this page. Material changes will be communicated when required by law.
